Fulfillment Policy

Full Coaching (Nutrition, Fitness, and Lifestyle)

The Parties hereby agree to the following terms and conditions:

1. GENERAL TERMS
Client acknowledges that he/she is contracting for the services of
K. Bliss Lifestyle LLC DBA Flex Performance (each such individual hereinafter referred to as a “Coach”). This agreement entitles any Coach employed by Company to work with Client to provide the services described in this Agreement.

2. SERVICES AND EXPECTATIONS

2A. SERVICES TO BE PROVIDED
Coach will design a tailored nutrition OR wellness lifestyle program (full coaching) for the Client that reflects the client’s objectives, health & fitness level, and experience. Coach will review the proposed program with Client prior to Client commencing the program. Client’s commencement of the program constitutes Client’s acceptance of the proposed program.

The program may include one or more of the following:

Custom nutrition protocols (including nutrition and daily water intake, information breakdown)

Custom supplementation recommendations

Weekly Consulting check-ins w/coach2

4-hour messaging support (outlined below in section 2B)

Fitness protocols (including education on fundamentals)

Aerobic/Cardiovascular conditioning and training if needed

Training activities, techniques, as prescribed/recommended by Coach

2B. K. BLISS LIFESTYLE DBA FLEX PERFORMANCE EXPECTATIONS

Coach and Client will have weekly check-ins to ensure Client is progressing through the coaching program via Loom. Check-in procedure is governed by the rules in the Flex Performance Client Handbook. Coach will be available for texting support and questions Monday through Friday. Clients will receive a response from their coach within 24 hours of the client’s last message sent (unless the message is sent on a after hours on Friday, Saturday, or Sunday, then the client will receive a response on Monday).Coach will not be available on Saturday & Sunday. Coach will respond to on time check-ins within 24 hours of submission (typically the following day). Late check-in submissions will still be accepted, however, will be responded to within 48-72 hours of submission.Check-ins will be submitted via Google Form provided. Clients will receive a Loom or Voice Memo response from their coach with feedback.Any nutrition or exercise protocol adjustments, or exercise form assessments, should be addressed during check-ins.Clients will follow the guidelines for “how to check in with your coach” listed in the Flex Performance Client Handbook.​​Educational resources to be provided on nutrition & exercise
Access to FB Group for community, support, and weekly trainings

The Company will auto draft Client on a monthly basis in equal monthly installments of the total cost agreed to on initial onboarding call, if the amount is not already paid in full at the time of initiation of services. Company shall supply Client an electronic receipt for all amounts paid under this Agreement. Pricing for the services provided in this Agreement shall be as stated on such invoice. Client agrees that all payments are to be made via Wave, Stripe, or Affirm. If payment is not made or is not authorized by Wave, Stripe, or Affirm, all coaching services will be suspended until a new payment is made by Client. Failure to submit a valid payment puts the Client in breach of contract but does not terminate the agreement.

Termination of agreement clause is outlined below in Section 6.4.

PRE-AUTHORIZED PAYMENTS

By executing this agreement, Client pre-authorizes K. BLiss Lifestyle LLC BDA Flex Performance, Fort Lauderdale, FL
to save a card on file for monthly recurring payments. In the event that Client wishes to cancel the contract, Client must follow the procedure outlined in Section 6 and pre-authorizes the Company to charge 50% of the remaining balance of the contract.

5. REFUNDS ON PAYMENTS

Client is
not entitled to refunds or chargebacks for any reason. All payments made to K. Bliss Lifestyle Operations pursuant to this agreement are final and are not refundable for any reason. Client agrees not to request, advise, file a claim, or seek the client’s bank or credit card company for a chargeback for consideration paid under this agreement. If a chargeback occurs, Client shall have materially breached the Agreement and shall forfeit all remaining services that have not yet been performed under the agreement. K. Bliss Lifestyle Operations shall have no further obligations to the client. Further, the amount of the chargeback shall be subject to a finance charge in the amount of one and one-half percent (1 ½ %) per month until paid in full by the Client. Further, K. Bliss Lifestyle Operations shall be entitled to recover from the Client all damages, and reasonable and necessary attorneys fees, and costs associated with pursuing collection and/or recovery of the amount of the chargeback.

6. TERMINATION OF AGREEMENT
The Parties shall have the right to terminate their Agreement upon written notice of termination to the other party. This writing must be via email or regular US mail. Text messaging shall not be considered written notice. If this Agreement is terminated by Client, Client shall pay a termination fee equal to fifty percent of the uncharged balance of their total package cost. Client is not entitled to a refund for cancellation.
This break contract policy applies to any re-signs and extensions agreed upon between coach and client.

Nutrition Only Coaching (Nutrition and Lifestyle)
